Airline Community Participation Terms of Use

These are legally binding terms and conditions (“Terms”) between AIRLINE TARIFF PUBLISHING COMPANY (“ATPCO”) and the entity you represent (collectively, “you,” “your” or “Participant”). These terms govern your use of ATPCO data, services, websites, software, and other electronic platforms that we operate and may update from time to time (collectively, the “Platform”).  

1. Background

ATPCO provides content, technology, standards, and governance throughout flight shopping. By using our Platform, Participant agrees to all terms and conditions and represents that it has the right, authority, and capacity to enter into these Terms. If you do not agree to any of these terms, then you may not use the Platform. Likewise, by using our Platform, Participant authorizes ATPCO to collect and distribute the Data, as that term is defined herein, on its behalf, either directly or via its agents (e.g., authorized partner airline, third-party service provider or any other authorized entity). In turn, ATPCO will store such Data, calculate results from such Data, and distribute either or both in accordance with these Terms.  The definitions of the terms used in these Terms are supplied in Exhibit B.

2. Standards

ATPCO collects, compiles, and curates various types of content, for pricing and retailing; a list of which is provided in Exhibit B which may be updated from time to time (collectively, the “Data”). As an industry body, ATPCO develops and publishes standards and procedures for airlines to manage pricing and retailing content and automation, that describe data exchanges, the processes to upload data, to calculate airline pricing and retailing, as well as processes for government and regulatory filing (individually and collectively “Standards”). These Standards are adopted and agreed to by the participating airlines and other parties engaged in the distribution and processing of airline pricing and retailing products (e.g., systems, channels and airline partners). These Standards govern the accurate collection, processing, distribution, and interpretation of airline retailing content. Any Data provided by you will be subject to these Standards. By participating in the Platform and using the Data, you agree to comply with the Standards. Our Standards may be updated from time to time and can be accessed here.

3. Data Use

You are not required to provide any Data but if you choose to do so, ATPCO will process and distribute the Data (including any calculated results) in accordance with applicable instructions, to systems, channels and partners, governments, and any entities that subscribe to receive the Data. ATPCO also collects certain categories of Data from public sources, including, without limitation, airline websites. By participating in the Platform, you are acknowledging that ATPCO selects, coordinates, and arranges data from you and other industry sources and has a proprietary interest in the resulting compilation that constitutes the Data.

Likewise, Participants may download Data from the Platform, in such case you agree that the Data is for your authorized reference only and may only be used for internal management purposes and no other purpose. Data may be used for internal use only. Participant may not create derivative works using the Data. Without limiting the foregoing, Participant may not use the Data to:

  • Authorize, or in any way assist, any computer terminal not operated by Participant or under its control to obtain access to ATPCO’s database;
  • Reproduce or duplicate any Data or other information obtained by Participant from ATPCO hereunder for purpose of resale,
  • Provide Fare Quote Service;
  • Provide a Pricing and Shopping System;
  • Offer Advertising using the Pricing Data;
  • Offer Travel Retail services using the Pricing Data;
  • Create, develop, operate, or sell Fare Management, Revenue Management, or Revenue Accounting products and services; or
  • Offer or provide any other services other than internal management functions unless expressly authorized by ATPCO in writing.

Participant may not share, resell, transmit, or transfer any of the Data furnished pursuant to the Terms to another person or entity for any purpose.

Upon receipt of necessary powers of attorney and/or other authorizations as appropriate, ATPCO will act as an agent of Participant for the sole purpose of filing tariffs with the government of the United States or other governments specified by and in accordance with the written instructions of Participant. It is the responsibility of Participant to ensure that all such filings adhere to the applicable regulations of the governmental authorities involved.

Participant shall not use the Data for any purpose which is in violation of any laws or regulations applicable to the Participant. Specifically, the Participant shall not use the Data for the purpose of money laundering, bid rigging, price fixing or other unlawful collusion, price signaling or exchange of competitively sensitive data or information.

3.1 Interline Fare Participation
ATPCO will include in its data bank and distribute fares for any airline which may have interline agreement(s) with other airline(s). Participant may instruct ATPCO to include in the Data and distribute such interline fares, and ATPCO assumes that all airlines have agreed to participation in such interline fares. Participant must have a valid interline agreement with each airline for which Participant wishes ATPCO to publish interline fares that provides for proper settlement of revenue associated with interline fares.

Participant shall not have the right to become a participant in an interline fare published by ATPCO on behalf of another airline without the consent of such other airline.

Participant may provide written instruction to restrict or withdraw another participant from an interline fare published by ATPCO. ATPCO will not act upon any instructions from the restricted/withdrawn party that is contrary to the Participant’s request. Participant may rescind the request with a subsequent written notice.

Participant may provide a written instruction to ATPCO to withdraw from participation in an interline fare published by ATPCO.

3.2 Routehappy Retailing Products
Access to the Routehappy retailing products via the Routehappy API (Amenities, Universal Product Attributes a/k/a Routehappy Visuals, Universal Ticket Attributes a/k/a Routehappy Attributes), and the Routehappy Hub as listed in Exhibit A (collectively, the “Routehappy Retailing Products”) is provided as part of the community participation governed by these Terms. Use of the Routehappy Retailing Products is subject to the obligations as described in Section 3.2.7.

3.2.1 Routehappy Retail Product Supported Languages

Supported languages and localizations for Routehappy Attributes include Arabic, Danish, Dutch, English (USA), English (UK), Finnish, French (Canada), French (France), German, Greek, Hebrew, Indonesian, Italian, Japanese, Korean, Norwegian, Polish, Portuguese (Brazil), Portuguese (Europe), Russian, Simplified Chinese, Traditional Chinese, Spanish (Spain), Spanish (Latin America), Swedish, Thai, Turkish, Vietnamese or other languages as ATPCO may determine from time to time in its sole discretion.

3.2.2 Authorized Access

Routehappy Retailing Products for use on the Participant’s Direct Channel will be accessed through the Routehappy API unless otherwise agreed by ATPCO in writing. A “query” to any of the Routehappy API includes data for up to 300 itineraries with up to 12 segments per itinerary. Routehappy Retailing Products are managed in the Routehappy Hub. Participant may access and use content only for flights that it operates, markets, or sells, subject to data availability and other conditions noted in these Terms. Participant may access the Routehappy Hub using a valid ATPCO-issued user ID through a terminal operated by an employee or designee of Participant to manage Routehappy Visuals.

3.2.3 Integration

Participant will be responsible for building Routehappy Visuals in the Routehappy Hub and integrating Routehappy Visuals and Routehappy Attributes with the Routehappy API in accordance with the Terms, which may be updated from time to time.
Participant will have no right to cache any data obtained from the Routehappy API, except within the same end user session and not to exceed 30 minutes, unless otherwise mutually agreed between the parties. Participant will implement any modified, new or enhanced versions of the Routehappy API no later than 90 days after release by ATPCO, beyond which older versions may no longer be supported. Except where specifically agreed with ATPCO, Participant will not publish Routehappy Visuals on Indirect Channels that require or suggest that the customer visit Participant’s website.

Participant may access and use Routehappy Products only to sell and market flights on Participant’s Direct Channels. Participant’s Direct Channels are limited to the domains listed shared with ATPCO, including mobile or desktop applications associated with these domains that provide similar functionality, wholly-owned and operated by Participant.

ATPCO will provide a report reflecting actual query usage by Participant’s Direct Channels to the Routehappy API upon Participant’s request to MyATPCO. Participant may request a query cap by submitting a request to MyATPCO. In such case, ATPCO will not deliver content beyond the query cap provided (and Participant shall not be responsible for payment of queries provided beyond the cap for that month).

Participant will be responsible for integrating the Routehappy Products in accordance with ATPCO’s Routehappy Content user conduct terms defined in Section 3.2.7, which may be updated from time to time.

3.2.4 Support

ATPCO will maintain and support both the Routehappy Hub and Routehappy API as well as provide associated updates, corrections, bug fixes and general enhancements, all of which will be made available to Participant without additional charge.
Participant shall determine the severity level of any problem and submit requests for ATPCO to provide support services to address and remediate those problems. To report problems users should access MyATPCO  and click on “Support.” Upon submission of a problem report users will receive immediate acknowledgement with a problem ticket number. Participant may check the status of their report online at MyATPCO, and ATPCO will follow up via e-mail with any questions or clarifications and will follow up via e-mail when the problem is resolved.

ATPCO will acknowledge receipt of a problem and begin addressing Severity 1 issues within fifteen (15) minutes of Participant’s notification of the problem, Severity 2 issues within thirty (30) minutes of such notification, and Severity 3 issues within four (4) hours of such notification.

ATPCO will address Severity 1 issues within eight (8) hours of Participant’s notification of the problem. ATPCO will correct or provide an update regarding Severity 2 issues within three (3) business days of such notification. Severity 3 issues will be resolved, if possible, in the next scheduled product release.

ATPCO products are provided using a commercially reasonable level of skill and care in line with industry standards, but results cannot be guaranteed. For example, ATPCO does not warrant the accuracy of Routehappy Retail Products due to the possibility of changes in airline and aircraft operations, fare filings and other events beyond ATPCO’s control (e.g., changes in airline products due to equipment swaps, fare or brand changes, fleet changes or unavailability of certain Routehappy Attributes at certain times). Notwithstanding the foregoing, ATPCO updates and verifies the Routehappy Retailing Products we provide.

3.2.5 System Availability

ATPCO will use commercially reasonable efforts to ensure that the Routehappy API will be available 99.8% of the time, excluding downtime for scheduled maintenance lasting no more than 2 hours per month, reasonable notice of which will be provided by ATPCO (“Routehappy System Availability”).

Complete, current product guides and documentation are available at developer.atpco.net. ATPCO will also be available to answer questions about ATPCO products.

3.2.6 Intellectual Property

These Terms do not convey any title or transfer of ownership of anyone’s intellectual property. All the data (e.g. photos, videos, tours, media, names, logos, text, descriptions) contained in Routehappy Visuals is provided by airlines, who retain ownership of such content. ATPCO does not, and Participant will not, make any claim to its ownership. However, by participating in the Platform, you are acknowledging that ATPCO selects, coordinates, and arranges data provided by airlines and other industry sources as well as data gathered from public sources about airlines. You further acknowledge that ATPCO has a proprietary interest in the resulting compilation that constitutes the Routehappy Retailing Products. All software, data and algorithms comprising the Routehappy Retailing Products, as well as its documentation, remain the property of ATPCO. Participant may not use Routehappy Retailing Products, including Routehappy Visuals, except in accordance with these Terms. Participant also agrees not to remove, obscure, or alter any legal notices displayed in or along with the Routehappy Retailing Products.

3.2.7 Routehappy Products User Conduct Terms

3.2.7.1 Routehappy API Restrictions

Participant agrees not to take any action using any aspect of the Routehappy API, in any manner, that:

  • is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another’s privacy, tortious, obscene, profane or which otherwise violates the ATPCO’s Routehappy Content user conduct terms;
  • intentionally infringes any third-party patent, trademark, trade secret, copyright, right of publicity, privacy right or other right of a third party;
  • unlawfully reveals any personal information about another individual, including another person’s name, address, phone number, electronic mail address, credit card information or any other information that could be used to track, contact or impersonate that person;
  • constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (“spamming”), chain letters or any form of lottery or gambling;
  • knowingly or negligently imposes an unreasonable or disproportionately large load on Routehappy’s computing, storage or communications infrastructure, or attempts to gain unauthorized access to the Routehappy API, other accounts, computer systems or networks connected to the Service, through password mining or otherwise; software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Routehappy or any third party;
  • unlawfully harvests, scrapes or collects any information from the Routehappy API or any ATPCO website;
  • unlawfully seeks to solicit information from or about minors; or unlawfully impersonates any person or entity, including any employee or representative of Routehappy.

3.2.7.2 Routehappy Visuals Restrictions

These restrictions ensure that airlines have greater control of visual content but it remains high quality, accurate, and trustworthy across the Platform.

Routehappy Visuals must comply with the following quality standards:

  • Routehappy Visuals must be relevant, align with associated text, and reflect the actual cabin equipment.
  • Misrepresentation is not allowed (e.g., showing seatback screens where none exist or displaying newer cabin products than those installed).
  • Routehappy Visuals must not be heavily edited or fully AI-generated, realistic renderings or AI-enhanced images are acceptable.
  • Routehappy Visuals must follow ATPCO’s published best practices, including accurate descriptions, correct targeting, and fact-based content.

ATPCO reserves the following rights over the Routehappy Visuals:

  • ATPCO retains final authority over all published Routehappy Visuals.
  • Content violating standards may be disabled or replaced by ATPCO without prior airline approval.

Regular audits will be conducted, with airlines notified of any issues needing correction.

4. ATPCO Rights of Data and Publishing Activities 

In order to serve all stakeholders in the industry, ATPCO reserves the right to adjust, add, edit, and limit the volume and schedule of Data distribution activities at any given time; such changes may come into effect immediately. By providing Data to ATPCO, Participant authorizes ATPCO to distribute Data to all channels through ATPCO’s subscription processes. Participant agrees to provide ATPCO with written instructions as applicable. Participant agrees that Data distributed publicly or privately via ATPCO may also be used for:

  • ATPCO’s internal use and analysis solely for the benefit of ATPCO;
  • ATPCO’s performance of services on behalf of and as expressly authorized by Participant; and
  • ATPCO’s performance of research and development activities on behalf of, in cooperation with, or as expressly authorized by Participant.

Participant has sole responsibility for verifying the accuracy of Data that ATPCO distributes regardless of whether the Data is provided to ATPCO by Participant, by an authorized designee of Participant, by a third party, or sourced publicly by ATPCO. If Participant becomes aware that information that ATPCO has sourced and is distributing is inaccurate, Participant agrees to notify ATPCO in writing so that ATPCO can correct any inaccuracies. ATPCO accepts no liability for the accuracy of “Other Industry-Sourced Data” as listed in Exhibit B, which ATPCO collects to enrich the Data.

ATPCO may terminate your access to the Data upon on the following:

  • Uncured non-payment past sixty (60) days
  • Violation of these terms, upon ninety (90) days’ written notice.

Participant may terminate its participation in the Platform upon ninety (90) days’ written notice.

5. Pricing 

In consideration for your use of the Platform, Participant agrees to pay a monthly charge to ATPCO, the “Community Participation Fee.”

ATPCO may, from time to time, revise the Community Participation Fee, after at least sixty (60) days’ written notice to Participant. Participant may terminate Platform use, by written notice given prior to the effective date of any increase in the Community Participation Fee. Should Participant so terminate its use, ATPCO agrees, if so requested by Participant, to continue to use the Platform hereunder for a period of six (6) months from the effective date of the increase to which such termination is attributable, at one hundred ten percent (110%) of the Community Participation Fee in effect immediately prior to such increase. In the event Participant withdraws its notice of termination prior to the expiration of the six-month period, Participant shall retroactively pay the difference between the increased pricing and the prior pricing, plus ten percent (10%) thereof, for said six-month period. 

6. Payment 

6.1 Invoice and Billing
ATPCO will invoice Participant monthly for the Community Participation Fee and Participant shall pay the full amount of such invoice and surcharges that may apply within thirty (30) calendar days after the date of such invoice. If Participant is a member of an industry clearing house, all sums payable under the Terms shall be paid through Airlines Clearing House (ACH) or IATA Clearing House (ICH) except for any such fees that are reasonably disputed in good faith by Participant. All payments shall be made in United States Dollars (USD). All amounts due are exclusive of taxes, and ATPCO shall not be responsible for any taxes (other than our U.S. income tax, if any) payable to any federal, state/province, local, or other government or jurisdiction in connection with these Terms. Participant shall timely pay any such taxes (and reimburse and indemnify ATPCO for any such taxes which are paid by ATPCO) and related costs, interests and penalties which any government or jurisdiction seeks to collect from ATPCO. Participant is responsible for providing ATPCO with a contact point for the purpose of receiving invoices.

6.2 Late Payments
Any amount billed that is not paid when due shall be increased, after the due date, at the rate of one percent (1%) per month until paid in full. 

6.3 Optional Billing
If Subscriber is a member of the Clearing House (ACH/ICH) but doesn’t settle through it, all sums payable under these terms shall be charged a 2% premium.

7. Limited Warranty and Indemnification 

We promise to operate within these levels of quality concerning Data  
ATPCO WILL USE COMMERCIALLY REASONABLE EFFORTS TO ENSURE THAT DATA SUPPLIED BY PARTICIPANT OR A THIRD PARTY OR SOURCED DIRECTLY BY ATPCO IS PROMPTLY AND ACCURATELY INCORPORATED INTO ATPCO’S DATA BASE AND MADE AVAILABLE FOR DISTRIBUTION IN ACCORDANCE WITH THE APPROPRIATE INDUSTRY, BILATERAL, OR MULTILATERAL AGREEMENT AND PARTICIPANT’S WRITTEN INSTRUCTIONS; HOWEVER, ATPCO CANNOT AND DOES NOT WARRANT THE TIMELINESS, ACCURACY, OR COMPLETENESS OF THE DATA OR ITS SUBSEQUENT DISTRIBUTION, NOR CAN IT ASSUME ANY LIABILITY FOR DAMAGES, CONSEQUENTIAL OR OTHERWISE, RESULTING FROM ANY DELAY IN, OR ERROR, OR OMISSION MADE IN THE COURSE OF THE INCORPORATION OR DISTRIBUTION OF THE DATA OR MADE IN THE COURSE OF PROCESSING TRANSACTIONS.

PARTICIPANT SHALL INDEMNIFY AND HOLD ATPCO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND REPRESENTATIVES, INCLUDING ATTORNEYS, HARMLESS FROM ALL CLAIMS OR SUITS, BY WHOMSOEVER BROUGHT (INCLUDING WITHOUT LIMITATION, ALL FEES ASSOCIATED WITH THE DEFENSE OF ANY SUCH CLAIM OR SUIT INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES AND EXPENSES AND EXPERT WITNESS FEES AND EXPENSES) ARISING FROM THE USE OF THE DATA OR TRANSACTIONS BY PARTICIPANT, BY ANY OF PARTICIPANT’S VENDORS, OR BY ANY THIRD-PARTY RECEIVING THE DATA.

This is our promise and indemnity for our Software and Cloud-Based Applications   
ATPCO will use commercially reasonable efforts to ensure that the Software Applications, as that term is defined in Exhibit A, will operate error free. Notwithstanding the foregoing, ATPCO cannot and does not assume any liability for consequential damages resulting from Participant’s use of the Software Applications.

THE SOFTWARE APPLICATIONS ARE PROVIDED “AS IS,” AND ATPCO MAKES NO (AND HEREBY DISCLAIMS ALL) REPRESENTATIONS WARRANTIES, WHETHER WRITTEN, ORAL, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NONINFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. ALL LIABILITY OF ATPCO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS COLLECTIVELY, TO PARTICIPANT, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE ATPCO COMMUNITY PARTICIPATION FEE PAID BY PARTICIPANT DURING THE MONTH THE INCIDENT GIVING RISE TO THE CLAIM. 

This limitation of liability for the Software Applications is cumulative and not per incident. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. 

8. Data Protection 

ATPCO has been certified as meeting all the requirements for maintaining a secure environment and effective information security controls per the Payment Card Industry Data Security Standard (PCI-DSS) and the International Organization for Standardization ISO 27001 Information Security Standard and will maintain such certification (or its equivalent) during the term of the Platform’s existence. The current ATPCO PCI-DSS and ISO 27001 certifications can be accessed here.

9. ATPCO Advertising and Publicity

For as long as you participate in the Platform, ATPCO will have the right to use Participant’s name and logo to identify it as a subscriber to ATPCO Services in customer lists, sales materials, and press releases. Should Participant elect to not participate in such advertising or publicity, they should submit a request through MyATPCO.

10. General Provisions 

10.1 Choice of Law and Jurisdiction  
These terms and conditions will be governed by the laws of the United States and the Commonwealth of Virginia without reference to its conflicts of law principles. Any court with jurisdiction, sitting within the Commonwealth of Virginia, will be the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms.   

10.2 Disclosure Required by Law
Notwithstanding other provisions of these Terms, ATPCO may disclose Data not otherwise publicly available to the extent required by a court of competent jurisdiction, the lawful requirement of a governmental agency or as otherwise required by applicable law. Prior to such disclosure, ATPCO shall provide Participant with reasonable notice so that Participant may have the opportunity at its expense to interpose objections, defenses, or obtain a protective order limiting disclosure and use of the information. 

10.3 Savings Clause
If any portion of these Terms  are found invalid for any reason, the agreements in place on the date of implementation of these Terms will apply. 

10.4 Notices
All notices given hereunder shall be delivered by email. Participants are responsible for providing ATPCO with a current email address for the purpose of receiving notices under these Terms, including (but not limited to) changes to ATPCO’s price list and updates to these Terms. 

10.5 Severability
If any provision of these Terms is prohibited or unenforceable in any jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by applicable law.

10.6 Headings
The headings in these Terms are for convenience of reference only and shall not define or limit any of the Terms or provisions hereof.

10.7 Updates and Concurrence with Future Amendments to Terms of Use
Participants continued performance under these Terms will constitute Participant’s agreement to be bound by amendments to the Terms. Continued performance may include, but is not limited by, paying an ATPCO invoice or accessing any portion of the Platform such as FareManager.

EXHIBIT A  

SOFTWARE APPLICATIONS AND SERVICES INCLUDED IN COMMUNITY PARTICIPATION TERMS AND CONDITIONS 

1. Software Applications  

The following “Software Applications” are available in MyATPCO or FareManager: 

  • Fares  
  • Rules   
  • Footnotes  
  • Routings  
  • General Rules  
  • Branded Fares  
  • Optional Services  
  • Carrier-Imposed Fees  
  • Ticketing Fees  
  • Linked Alliance Fares  
  • Service Fees Analysis  
  • Government Filing System (GFS) (subject to terms and restrictions)
  • Architect Query
  • Routehappy Hub
  • Express Contracts

Limited access to GFS, Architect Query, and Express Contracts is provided at no additional cost. Product use beyond the included usage is subject to charges as described in ATPCO’s price list.

2. Services  

  • Access to the Routehappy API*
  • Access to ATPCO’s library of free e-learning courses, virtual training sessions, and on-demand videos.   
  • ATPCO hosted webinar “Knowledge Sessions” that demonstrate ATPCO products or discuss industry developments.   
  • Customer Service for general inquiries and technical support.    
  • Access to ATPCO’s Participant portal, MyATPCO, providing access to ATPCO company information, product information, and product documentation. 
  • Ability to participate in ATPCO working groups, which provide the opportunity to influence change and discuss the development of ATPCO products and standards.   
  • Support from ATPCO to stay in compliance with industry mandates, such as those from IATA.

EXHIBIT B

DEFINITIONS

Advertising means the use of fares and rules data to provide web travel advertising such as dynamic metasearch displays or qualified paid links that generate qualified purchase inquiries.

Amenities: see the definition of Flight Attributes.

ATPCO means the Airline Tariff Publishing Company.

Community Participation Fee consists of three main components:

  • Community Access: This fixed base fee provides you access to ATPCO’s community of airlines and channels, as well as many industry services and benefits.
  • Occupancy: This variable charge is based on your organization’s volume of ASKs and data stored with ATPCO.
  • Activity: This variable charge is based on the number of changes your organization makes to the data your organization stores in ATPCO.

Data includes the following categories of data defined herein:  

  • “Pricing Data”includes the following:
    • Published Fares    
    • Add‐Ons
    • Constructed (Unpublished) Fares  
    • Construction Data Tables

    • Text Rules and Footnotes  
    • Negotiated Fares and Rules

    • Passenger Facility Charges (PFCs)

    • Carrier‐Imposed (YQ/YR) Fees

  • “Retailing Data” includes the following:
    • Routehappy Attributes

    • “Other Industry-Sourced Data” includes the following:
      • Reason for Issuance Code (RFIC)
      • Bank Identification Number Database (BIN BASE)
      • IATA Ticket Tax Box Service (TTBS)
      • Revenue Accounting Tax Database (RATD)
      • OAG Schedule Data  
      • Other Industry-Sourced Data to enrich other Data types

Direct Channel means the websites, applications, and software controlled by Participant together with all subdomains and regional variants, mobile applications, call centers and email marketing campaigns, banner ads and other marketing incorporating Participant’s rich content.

Fare Management means a suite of services and systems that enable airlines and partners to manage, distribute, and optimize fare-related data.

FareManager means the primary online access portal to ATPCO’s suite of fare management and pricing analysis applications including, but not limited to Architect, Architect Query, Fares, Rules, and GFS.

Fare Quote Service means the use of fares, rules, and merchandising data to price, verify the price of, or manage a passenger’s itinerary or the electronic display of fares, rules, and merchandising data for those purposes

Flight Attributes means a database of Participant’s passenger experience attributes organized by flight and cabin and includes the categories of seat, layout, aircraft, wi-fi, entertainment, power, food, and beverages. Flight Attributes are also known as Amenities.

Indirect Channels means one or more channels controlled by a third party (e.g., GDS, travel agency, or metasearch) through which Participant distributes its rich content.

Other Industry-Sourced Data has the meaning provided in Exhibit B herein.

The terms “Participant,” “you” and “your” refer to the entity you represent that uses the Platform.

The term “Passenger Services System” used herein shall mean a system that shall include any or all of the following subsystems: reservation, inventory, departure control, fare quote, and ticketing.

Platform means the Data, services, websites, software, and other electronic platforms that ATPCO operates and may update from time to time.

Pricing and Shopping System means a system that provides pricing and shopping to Passenger Service Systems, distributors of fares and fare-related data, airline travel retail marketers and search engines. Such Pricing and Shopping Systems are search and calculation tools, which process high volumes of fares instantly or almost instantly and return pricing and shopping options in real time.

Pricing Data has the meaning provided in Exhibit B.

Retailing Data has the meaning provided in Exhibit B.

Revenue Accounting means the processes and systems used to manage and validate interline billing and settlement between airlines.

Revenue Management means the process used by an airline to optimize revenue by managing pricing strategy and the control of inventory availability, ancillary services and other products.

Routehappy Attributes consist of Flight Attributes and Ticket Attributes.

Routehappy Hub means a software platform developed by ATPCO for airlines to create, manage, target, and publish the Routehappy Retailing Products.

Routehappy Retailing Products has the meaning provided in Section 3.2 herein.

Routehappy Visuals consist of targeted merchandising content assembled with media (e.g., photos, videos, infographics, or 360-degree virtual tours) of an aircraft.  Routehappy Visuals are also known as “Universal Product Attributes” or “UPAs.” Routehappy Visual categories include: 

  • Flight: aircraft, seat, meals, beverages, entertainment, power, wi-fi, service (inflight), upgrade
  • Departure: transport to airport, check in, departure terminal, departure lounge, gate & boarding, service (departure)
  • Connection: stopover, connecting ease, connecting terminal, connecting lounge, service (connecting)
  • Arrival: baggage collection, arrival terminal, arrival lounge, arrival transport, service (arrival)
  • Airline: schedule/route, loyalty program, brand, promotion

Software Applications has the meaning provided in Exhibit A herein.

Standards has the meaning provided in Section 2 herein.

Terms has the meaning provided in the recitals.

  • Create, develop, operate, or sell products and services; or 

Ticket Attributes are structured data, processed, normalized and translated by ATPCO based on Participant’s ATPCO filings to enrich ticket and fare attributes in flight shopping and include the categories of advance change, cancellation, same day change, checked bag allowance, carry on allowance, seat selection, upgrade eligibility, check in priority, boarding priority and lounge access. Ticket Attributes are also known as “Universal Ticket Attributes” or “UTAs.”

Travel Retail Service means shopping and booking facilities for the Participant (or Customer) to sell travel services directly to travelers.
